Transparency 2020: Free Speech and Election Integrity, with Nadine Strossen and John Yoo

What should social media policy look like during an election season, if the goal is to support election integrity and trust in the outcome of an election?

Watch this discussion I moderated on Wednesday, exploring the relationship between freedom of speech and election integrity, particularly as it applies to social media policy, between Nadine Strossen and John Yoo. Strossen is the emerita John Marshall II Professor at New York Law School and served as the first woman national President of the American Civil Liberties Union, from 1991-2008. Yoo is the Emanual S. Heller Professor at University of California at Berkeley School of Law, a Visiting Scholar at the American Enterprise Institute, and Visiting Fellow at Stanford University’s Hoover Institution.

“All of those excuses and pretexts — emanating largely from a national media that is all but explicit in their eagerness for Biden to win — served for the first week or more after the Post story to create a cone of silence around this story and, to this very day, a protective shield for Biden. As a result, the front-running presidential candidate knows that he does not have to answer even the most basic questions about these documents because most of the national press has already signaled that they will not press him to do so; to the contrary, they will concoct defenses on his behalf to avoid discussing it.”

So...since none of the Biden family corruption can be "verified" this information isn't important to know/newsworthy or is "Russian propaganda"? So exactly what amount of the marxist media claims made regarding President Trump were "verified "? None you say? Riiiiiiight....

There is alot more to the Glen Greenwald story than what his supporters are reporting. They are covering up for Greenwald in the same way Twitter is covering up for Joe Biden. And that is a fact:

I published this last night:

You've got to be kidding me. I just found out that Glenn Greenwald is living in Brazil with his homosexual "spouse" David Miranda. And Miranda is a radicalized socialist as in an AOC type Antifa socialist. Do people even in look into the backgrounds of people before they glorify them. Here we are in America battling Antifa and the socialists trying to destroy us and steal our freedoms AND Glenn Greenwald is shacked up in Brazil with his radicalized socialist gay lover. Give me a break! Miranda is a member of the Brazilian Socialism and Liberty Party which is a straight up rabidly communist political group.

Ad hominem. And what do you have against homosexuality?

@AmyPeikoff Why are you covering up for the fact that Greenwald lives in Brazil with a far left Socialist extremist who is fighting against capitalism and democracy. You are covering this up at the same time you are complaining about censorship on social media. The very people who are pushing censorship in America on social media are the same people Glenn Greenwald is shacked up with in Brazil and the same identical ideology of communist traitor Bradley-Chelsea Manning. This hypocrisy is disgraceful.

This is the socialist-marxist organization that his homosexual lover Miranda is involved in. Greenwald is shacked up with him in Brazil because the U.S. would never allow Miranda to live in the U.S. That's why Greenwald doesn't live in the U.S. Greenwald is a fraud. He couldn't care less about our Constitution and Democracy. That's why he was willing to be involved with treasonous traitor Snowden who sold our nation up the river by stealing and then disclosing all of our nation's military secrets under the guise of advocating for our rights. Bologna, he was trying to undermine America in partnership with communist transgender lunatic Bradley-Chelsea Manning. This is infuriating.

Nothing new here. I've seen worse. Of course, I must admit that it was in the Soviet Union where ALL even potential dissent was immediately muzzled and completely innocent people were sent to forced labor camps. But, as one Brit Socialist (in)famously said: "You can't make an omelet without breaking eggs." All MSM have been biased for a long time, but now they are literally, completely “in the tank” for #Leftist #propaganda
Also figuratively “in the tank” 🚽 🚽 💩💩💩💩💩💩💩💩💩💩

It seems that Glen Greenwald may be the last of the journalists whose dedication is to the story, where ever it leads. Of all the partisan "hack stories" of the last four years, nothing has revealed the true intent of the media like the cover up of the Biden crime family. It truly begs the question, "Whats in it for them"?

Gleen Greenwald just earn an absurd amount of respect and credibility by doing this. It's not an empty talking point: the man put his name and salary on the line by taking a principled stance against activists pretending to be journalists.

I hope this gets a few people to snap out of their derangement.

We clearly have a case of treason against Americans by the Democratic Party, their media and the corrupt Biden family. This is terrorism and another attempt against our democracy by the Democratic Party and the media outlets they control with handouts and promises for the future. This has to stop now.

Mr. Greenwald is right to quit. I admire that. And I actually feel bad when a left leaning reporter like Mr. Greenwald who tries to have integrity is mistreated by other leftists. It’s always an ugly thing to witness. I hope he can create a new opportunity for himself and keep up the good reporting from another venture.

Apparently you just have to vote for him to find out what type of leader he will be. 🤪🤪

“Breaking up or regulating these Big Tech companies would be a wrongful initiation of force. Regulation would also exacerbate the problems by creating more barriers to entry for innovators. Plus, as one commentator observed, it would make companies in the information sector more subject to federal government control. It was a relatively free market that saw these four companies go from garage-based businesses to powerful tech giants. If and when they are supplanted by alternatives that consumers — who are learning more about the pitfalls of online life every day — are more comfortable with, that same free market is our best hope.”

I’m not for more govt regulations, no doubt, and absolutely the market should deal with these guys, but perhaps there is a place for some degree of regulatory punishment for their misbehavior. Otherwise considering the power they have, it would be quite difficult for the market to punish them.
No simple solutions here.

Except that these companies are protected by the government from lawsuits resulting from third party posts, which assumes they’re neutral. From what we’ve seen, they are far from neutral and are prohibiting posts that don’t fit their political agenda and are acting as active editors openly trying to influence an election. By the same principles of a free market, they should lose those protections and allow the courts to settle any disputes that arise from those actions and any damage that arises from their editing. At the moment they are cronies protected by the government, which is unfair to those who actually edit and are open to lawsuits.

We are so used to centralized government solutions these days we forget about the vestiges of federalism that are still left like the fact states control their own elections and each state has a different set of rules for their elections.

I’m not sure it’s really the delegated power of scotus to determine the rules of state elections as much as it is Congress’ when there is confusion and doubt about the national general election for potus.

Many states are obviously trying to do an end run around the EC without properly altering or changing the Constitution. So there is clearly a brewing conflict over this issue along with so many others at this time.

Our courts are so corrupt.
That’s the real reason dems are livid about Trump filling positions and taking away their legislation from bench.
They’ve been the ones corrupting the system for decades while do nothing repubs say on their hands.

Whatever it takes to steal the election.Ive never see the likes of what they're doing.

Why aren't "lost" ballots that are recovered ever Republican? They ALWAYS benefit Democrats!

Another good reason to vote in person either early or election day!

So even with Supreme Court balanced towards the conservatives, the republicans lost the appeal - almost like Justices upheld the constitution instead of writing new laws.

You better believe there are storage units throughout the Pittsburgh and Philadelphia areas that are packed with soon-to-be miraculously “found” ballots - all for Biden.

This will be a joke, Trump is going to be getting states voting red this year that were blue before. Their votes will not swing the election any direction at this point, even though their liberal representatives are attempting to make things different. November 3rd, Trump will known as the winner, November 4th will be the day the nation has a party.

This is unwise, just as it is unwise to claim that there is no "climate change."

Maybe they (whoever is deciding on messaging) present it this way, because they believe that people are too stupid for nuance? That no one is able to understand that, even though there is *some* risk, the risk does not justify draconian measures, and certainly not draconian measures imposed by government?

Expect more of people. Tell the whole truth. We probably need to be vigilant about this virus for several more months, but that doesn't mean lockdowns, mandatory masks everywhere, etc., etc., are justified.

The climate has always been changing. Let Mother Nature run things .

Do we now have a casedemic or a pandemic . We are testing more . There are a lot of false positives and there are a lot of asymptomatic cases . How many people are actually dying from the virus should be the question .

Show Replies

Well said‼️Cases do not equate with symptoms‼️ Hospitalizations are a better metric✅

I believe that the collectivists need to be defeated or at least diminished to insignificance soon. This election can hopefully accomplish that goal. After that people who believe in liberty and individualism must turn their focus to fighting the government “mandates”, and related main stream media propaganda related to health. There are very few things that are more individual than our own health and our decisions related to our own health.

It is clear that democrats, socialists, etc are much more inclined to issue these health edicts. They need to be voted out. Then we need to rally against republicans who still want to dictate our behavior. We also need to begin a long, hard search for leaders who understand and support our individual freedoms.

The climate has been changing for over 350 million years

In some sense I think this is just “strategic bluster”. The concept of anchoring in negotiations—I say I ended it, you have to start from there to argue back against me. I end up focused on my success at ending the effects of the pandemic and the public says “close enough”.

Just a guess at what the idea is. I agree with your ... hope that logic would be better. That may depend on whether we correctly guess the average intelligence/attention span of the audience. We might be inclined towards too much generosity in that regard.

Bluster is a blunt instrument, but it’s Trump’s strong suit. )I wish he would dump Fauci and let Atlas be the voice on this. Delegate the “reasoned, fact-based argument” thing to someone who’s good at it.)

The article is false in its interpretation. The admin doesn’t claim to have ended the pandemic.

The article is #fake news, at least in the way the press release was interpreted. In no place does the administration claim to have ended the pandemic, both in the press release and the report. Similarly, the administration doesn’t deny the climate is changing. They just deny the greatly exaggerated statements about the climate not based in the science; i.e. the hockey stick, the computer modeling, existential threat rhetoric, the Socialists programs driving the narrative.

Rational selfishness has an heuristic experience and execution gradient, naturally.

"Too stupid for nuance?" Do you know what this is? This right here explains why libertarianism could never work. Yes, most people are stupid enough that maximizing their happiness or even just protecting them requires coercing them. If those with the responsibility to coerce them are too deluded by jews to do it, lies become necessary. But once a society resorts to lies, they have fully surrendered to the jews, the children of the devil. Lies are the jewish habitat. Government lies are like IV ports impanted in every goy for jews to suck him dry at their leisure. #WhiteSamsonOption

SMH... when you were younger and got sick did your mommy tell you that you will run a fever for several days, then have an ear ache for two nights, have almost intolerable headaches for several days? Or did she loving tell you that you will get better, SO THAT YOUR FOCUS WOULD BE ON RESTING AND HEALING instead of worrying about the symptoms all night?
Take a lesson from moms, stop with the panic porn...

Agreed. This is bad messaging, it sets themselves up for partisan bodyslamming for every new Covid case.

You can't claim victory if you don't define what victory is.

Maybe better messaging would be,"open up the country, get back to normal, find and distribute medications to manage this disease, just like we manage other diseases."

A good sentiment they are trying to convey, but you're right, it's unwise. But it's an easy fix. Hope they clean up the messaging a bit.

Global Warming last decade, Climate change this decade, whatever the hell you want to call it next decade.

With less driving going on, I thought there would be stories about how helpful it is to the environment. Nope, al I hear is it’s still gloom and doom.

Contrary to orthodoxy, the election of a President who wins an Electoral College majority but loses the national popular vote to the opponent is not suspect. The Constitution establishes a Republic featuring a separation of powers and checks and balances to safeguard against the danger of majoritarian tyranny. By diffusing power, the Constitution aims to prevent any political faction from oppressing rivals. The goal is optimizing individual liberty, not facilitating the majority in cramming its views down the throat of the minority. The Electoral College gives disproportionate influence to States with small populations by awarding electoral votes based on the number of a State’s Representatives plus their two Senators. It complements the anti-majoritarian composition of the Senate where each State enjoys equal representation from Wyoming with a population of 580,000 to California with a population exceeding 39 million. Thwarting majorities is not gridlock but a celebration of liberty.
